IRS Streamlined Procedure– Downtown Toronto US Tax Return Preparation
IRS Streamlined or “Catch-up” filings (Voluntary Disclosure) US Tax Returns and Forms.
The streamlined filing compliance procedures described below are available to taxpayers certifying that their failure to report foreign financial assets and pay all tax due in respect of those assets did not result from willful conduct on their part. The streamlined procedures are designed to provide taxpayers in such situations with
- a streamlined procedure for filing amended or delinquent returns, and
- terms for resolving their tax and penalty procedure for filing amended or delinquent returns, and
- terms for resolving their tax and penalty obligations.
FBAR – Downtown Toronto US Tax Return Preparation
A United States person, including a citizen, resident, corporation, partnership, limited liability company, trust, and estate, must file an FBAR to report:
- A financial interest in or signature or other authority over at least one financial account located outside the United States if,
- The aggregate value of those foreign financial accounts exceeded $10,000 at any time during the calendar year reported.
Foreign Tax Credit – Form 1116
To claim the foreign tax credit if you are an individual, estate, or trust, and you paid or accrued certain foreign taxes to a foreign country or U.S. possession. Claim credits for taxes paid and taxes withheld. Foreign tax credit
Treaty-based disclosure claims – Form 8833
If you claim treaty benefits that override or modify any provision of the Internal Revenue Code, and by claiming these benefits your tax is or might be, reduced, you must attach a fully completed Form 8833, Treaty-Based Return Position Disclosure Under Section 6114 or 7701(b), to your tax return. See Exceptions, below, for the situations where you are not required to file Form 8833.
You must file a U.S. tax return and Form 8833 if you claim the following treaty benefits:
- A reduction or modification in the taxation of gain or loss from the disposition of a U.S. real property interest based on a treaty.
- A change to the source of an item of income or a deduction based on a treaty.
- A credit for a specific foreign tax for which foreign tax credit would not be allowed by the Internal Revenue Code.
You must also file Form 8833 if you receive payments or income items totaling more than $100,000 and you determine your country of residence under a treaty.
Health Coverage Exemption – Form 8965
The individual shared responsibility provision requires taxpayers to do at least one of the following:
- Have qualifying health coverage called minimum essential coverage
- Qualify for a health coverage exemption
- Make a shared responsibility payment with their federal income tax return for the months that without coverage or an exemption.
Beginning in Tax Year 2019, Forms 1040 and 1040-SR will not have the “full-year health care coverage or exempt” box and Form 8965, Health Coverage Exemptions, will no longer be used. You need not make a shared responsibility payment or file Form 8965, Health Coverage Exemptions, with your tax return if you don’t have minimum essential coverage for part or all of the year.
Foreign earned income – Form 2555
If you qualify, you can use Form 2555 to figure out your foreign earned income exclusion and your housing exclusion or deduction. You cannot exclude or deduct more than your foreign earned income for the year.
Net Investment Income Tax (NIIT) – Form 8960
Form 8960 is the IRS form used to calculate your total net investment income (NII) and determine how much of it may be subject to the 3.8% Medicare contribution tax. The net investment income tax (NIIT) is a 3.8-percent tax on the smaller of your net investment income or modified adjusted gross income. The tax only applies if you report net investment income; your wages and self-employment earnings, by themselves, have no impact on the NIIT.
